SiteBalance is operated by SiteBalance Ltd. Our website is https://sitebalance.co.uk. Our business address is available on request.

Agreement
By using SiteBalance, the customer agrees to these Terms of Service. SiteBalance is intended for business and company use by UK organisations. It is not intended for consumer or personal household use.
The service
SiteBalance provides digital workplace and site record tools, including daily diaries, site and project records, vehicle checks, plant checks, HAVS and HSEQ records, photo and signature uploads, audit trails, user and role management, company and site records, and account or invoice records where applicable.
Customer responsibilities
Customers are responsible for the accuracy of submitted records, choosing who gets access, setting appropriate roles and permissions, complying with UK law and workplace obligations, meeting health and safety duties, arranging vehicle, plant, HAVS, LOLER, PUWER, and other statutory checks or inspections, retaining records for required periods, making sure users submit truthful information, reviewing records, acting on faults or issues, and keeping login credentials secure.
User accounts
Users must use accurate account details and must not share passwords. Customers are responsible for deciding which users should have access to their workspace and for removing access when it is no longer needed. SiteBalance may suspend access where we reasonably believe there is misuse, a security risk, non-payment, or a legal requirement.
Records and audit trail
Submitted records may form workplace, safety, compliance, and audit records. Users may edit submitted records only as allowed by the app policy. Amendments may be recorded in the audit trail. Deletion may be restricted or replaced with archive or soft-delete. SiteBalance does not guarantee that edited or deleted records can always be permanently removed where retention, audit, backup, or legal reasons apply.
No professional advice
SiteBalance is software only. It does not provide legal, health and safety, engineering, inspection, compliance, roadworthiness, medical, or occupational health advice. It does not replace competent health and safety advice, legal advice, employer risk assessments, statutory inspections, LOLER, PUWER or other legal duties, HAVS medical or safety management, vehicle roadworthiness checks, or any customer legal obligation.
Availability
SiteBalance aims to provide reliable access, but we do not promise uninterrupted or error-free service. Maintenance, hosting issues, internet issues, security incidents, third-party outages, and other operational events may affect availability.
Data, backups, and retention
SiteBalance will use reasonable measures to protect and back up service data. Customers remain responsible for exporting and retaining records they legally need. Retention is handled under the Privacy Policy, our Data Retention Policy, and any written customer agreement. Uploaded media and files are part of customer records.
Acceptable use
Users must not submit unlawful, false, abusive, harmful, or misleading content; upload malware or illegal material; attempt to access another company's records; interfere with the service; reverse engineer or misuse the platform; or use the service for anything unlawful.
Fees and payment
Fees, subscriptions, or invoices may be agreed separately in writing. Payments are not currently processed directly inside SiteBalance. If payment processing is added, it may be handled by a third-party provider. Non-payment may result in suspension after notice. Prices, plans, and features may change with notice.
Intellectual property
SiteBalance Ltd owns the SiteBalance software, branding, design, and platform. Customers retain ownership of and responsibility for their submitted records and uploaded content. Customers grant SiteBalance permission to process, store, display, and transmit customer content as needed to provide, secure, support, and improve the service.
Confidentiality
SiteBalance will handle customer data responsibly. Customers must also keep login details, business information, site records, and exported data secure and must make sure their users do the same.
Limitation of liability
Nothing in these terms excludes or limits liability where it would be unlawful to do so. Subject to that, SiteBalance is not liable for indirect or consequential loss, lost profits, lost business, loss of goodwill, or losses caused by inaccurate customer data, customer failure to review or act on records, customer compliance failures, or use of the service as a substitute for professional advice.
Where legally allowed, SiteBalance's total liability may be limited to the fees paid by the customer for the service during a reasonable period before the event giving rise to the claim, or another limit agreed in writing.
Suspension and termination
A customer can stop using the service. SiteBalance may suspend or terminate access for non-payment, misuse, security risk, breach of these terms, or legal requirement. Data export and retention after termination are subject to the Privacy Policy, retention policy, and any written agreement.
Changes to these terms
SiteBalance may update these Terms of Service from time to time. Where appropriate, we will notify customers of material changes.
Governing law
These terms are governed by the laws of England and Wales.
